Liability Waiver

Please read and sign the following waiver before attending our playground.

IMPORTANT: This waiver is MANDATORY for anyone entering and/or using the KIDZ PLAY IN
LALALAND facility. For guests under 18 years of age, this form must be completed and signed by a
parent or legal guardian.

By accessing or using any equipment, amenities, or property at KIDZ PLAY IN LALALAND, all
Participants and their accompanying guests agree to abide by the posted Facility Rules and to the
terms of this Release of Liability and Waiver.

By signing this document, you agree to waive certain legal rights, including the right for you or your
child(ren)/ward to pursue claims or seek damages in the event of an accident, regardless of cause.

PLEASE READ CAREFULLY BEFORE SIGNING.

ASSUMPTION OF RISKS

I acknowledge, on behalf of myself and my child(ren)/ward, that participation in activities at KIDZ
PLAY IN LALALAND involves inherent risks. These may include—but are not limited to—physical or
emotional injury, paralysis, death, or property damage. I understand these risks may arise from the
use of the facility, equipment, or interaction with others.

With full knowledge of these potential risks, I voluntarily agree that I and my child(ren)/ward will
participate in all activities at KIDZ PLAY IN LALALAND, operated by its employees, directors,
officers, agents, and volunteers (collectively, “KIDZ PLAY IN LALALAND”).

MEDICAL PERMISSION AUTHORIZATION

If the participant is of minority age, the undersigned parents or guardian hereby gives permission
for KIDZ PLAY IN LALALAND to authorize emergency medical treatment as may be deemed
necessary for the Minor’s named below while participating in KIDZ PLAY IN LALALAND activities.
The undersigned hereby releases, discharges, covenant not to sue and agrees to indemnify and
save and hold harmless KIDZ PLAY IN LALALAND from all liability, claims, demands, losses or
damages on the Minors account caused or alleged to have been caused in whole or in part by the
negligent medical treatment, failure to provide medical treatment, or negligent rescue operations,
and further agrees to indemnify, save and hold harmless KIDZ PLAY IN LALALAND from any
litigation expenses, attorney fees, loss liability, damages, or costs incurred by KIDZ PLAY IN
LALALAND as a result of any such claim.

WAIVER AND RELEASE OF LIABILITY

In consideration of being permitted to use the facilities at KIDZ PLAY IN LALALAND, and for other
valuable consideration received, I hereby agree, for myself and on behalf of my child(ren)/ward, to
the following:

• TO WAIVE AND RELEASE any and all claims, demands, or causes of action that I, my
child(ren)/ward, or anyone acting on our behalf, may have now or in the future against KIDZ
PLAY IN LALALAND or any other participant, arising out of participation in facility
activities—including, but not limited to, injuries, damages, or losses resulting from
negligence or failure to protect against such risks.

• TO HOLD HARMLESS AND INDEMNIFY KIDZ PLAY IN LALALAND and its representatives
from any and all liability, including claims for personal injury or property damage, arising
from participation by me and/or my child(ren)/ward.

• I acknowledge that no verbal or written assurances or guarantees have been made to me
beyond what is outlined in this Agreement and that I have not relied on any statements not
included herein.

ADDITIONAL TERMS

• Effective Date: This Release of Liability and Waiver becomes effective on the date signed
below.
• Severability: If any part of this Waiver is found to be invalid or unenforceable, the remaining
provisions shall continue in full force and effect.
• Governing Law: This Agreement is governed by the laws of the Province of Ontario and the
federal laws of Canada, where applicable. I consent to the exclusive jurisdiction of the
courts located in Toronto, Ontario for the resolution of any disputes.
• Binding Effect: This Waiver is binding upon myself, my child(ren)/ward, and our respective
heirs, successors, and assigns.
• Entire Agreement: This document represents the full and complete agreement regarding
liability and supersedes any previous oral or written agreements.
• Costs and Expenses: I agree to reimburse KIDZ PLAY IN LALALAND for any out-of-pocket
expenses, including legal and advisory fees, incurred as a result of enforcing this
Agreement.

I confirm that I have read and understood both this Release of Liability and Waiver and the Facility
Rules posted at KIDZ PLAY IN LALALAND. I have reviewed these rules with my child(ren)/ward and
accept responsibility for their compliance.

By signing below, I acknowledge that I have freely and voluntarily entered into this agreement. I
confirm that I am the parent or legal guardian of the child(ren)/ward listed and that the information
provided is accurate and may be used for safety and contact tracing purposes.

What ages is KIDZ PLAY IN LALALAND suitable for?

Our playground is designed for children aged 0-12 years. We have specific areas dedicated to different age groups, including a separate toddler zone for our youngest visitors (ages 1-3), ensuring a safe and enjoyable experience for all children.

Do parents/guardians need to pay an entrance fee?

No, parents and guardians enter for free! We encourage adults to actively supervise their children and join in the fun. Only children who are playing need to purchase tickets. Adults are only allowed entry if accompanied by a child.

Are there any clothing requirements?

For hygiene and safety reasons, all children and supervising adults must wear socks in the play areas. If you forget to bring socks, they can be purchased at our front desk. We also recommend comfortable clothing that allows freedom of movement.

Can I bring my own food and drinks?

Outside food and beverages are not permitted, except for baby food and formula. For birthday parties, special catering packages are available.

How do you ensure the playground is clean and safe?

We implement rigorous cleaning protocols throughout the day, with a thorough sanitization of all play equipment and surfaces each evening. Our staff regularly inspects play areas to maintain safety standards, and we have first-aid trained personnel on-site at all times.

Do I need to book in advance?

While walk-ins are welcome subject to availability, we recommend booking in advance, especially during weekends, holidays, and peak times. This ensures your spot and helps us manage capacity for the best experience. Birthday parties and group bookings must be reserved in advance.

Are there any special accommodations for children with special needs?

Yes, we strive to make our playground inclusive for all children. We offer quieter sections for children who may benefit from a less stimulating environment, and our staff is always willing to assist children with various needs. Please contact us in advance to discuss any specific requirements.

How many adults need to accompany the children?

We require at least one adult (18+ years) for every five children aged 5-12, and one adult for every three children under 5 years. Adults must actively supervise their children at all times while in the facility.
